【禁聞】艾未未被指「經濟犯罪」 各方質疑

【新唐人2011年4月8日訊】艾未未在機場失蹤三天之後，中共喉舌《新華社》6號發佈消息，聲稱“艾未未因為「經濟犯罪」正依法接受調查”。官方媒體《人民日報》旗下的《環球時報》也對艾未未被抓事件發表社論，指稱艾未未長期以來試探法律底線，將為此付出代價。

自從4月3號艾未未從機場失蹤之後，他的家人至今仍然沒有收到當局的通知。7號凌晨，《新華網》以英文發出一則消息說，艾未未因為涉嫌經濟犯罪，正在接受調查。但是，這條消息很快就被刪除。而香港《文匯報》轉載了這一消息。

在此前一天，《環球時報》發表社論，指稱艾未未是一個“特立獨行者”，經常幹別人不敢幹的事，並且身邊聚集了一群這樣的人。還說，艾未未屢屢挑戰中國法律的紅線，他會為自己的特殊選擇付出代價。

《中國律師觀察網》的主編趙國君，批評《新華社》、《人民日報》和《環球時報》在內的很多中國媒體，涉嫌妨礙司法公正，因為在沒有法律審判的情況下，已經給公民定罪。

趙國君（《中國律師觀察網》主編）：「所有的案件，無論你們資本主義法律還是社會主義法律，無論美國鬼子還是共產黨，都是有一句話，就是必須一個人經過審判之後才能定罪。審判之前任何人不能評論瞎說八道。所以你看《環球時報》發表一篇社論，這本身就是荒唐的。」

趙國君說，如果艾未未真的涉嫌經濟犯罪，那麼依法處置沒有問題。但是他質疑，艾未未被抓走的合法性問題。

趙國君（《中國律師觀察網》主編）：「無論『特立獨行』的公民或者普通公民，他涉嫌犯某個罪，這個都有可能。但是在涉嫌之前，我們的這個法律機關和政府是否能依照法律手段來做這件事情。這是關鍵。法律上沒有被帶走這個概念，也沒有失蹤這個概念。」

香港「中國維權律師關注組」執行秘書潘嘉偉，對《德國之聲》表示，中共當局的做法“國際社會是不會接受的”。

潘嘉偉（「中國維權律師關注組」執行秘書）：「突然之間有官方媒體做一些動作，把他（艾未未）說成罪犯為此中傷他，沒有給家屬任何的一些文件、任何一個說法，這怎麼可能是一個法制國家會做的事情呢？這個已經違反了中國自己的法律的規定。」

艾未未被捕之後，德國政府已經提出抗議。

而在北京天安門廣場邊的「中國國家博物館」，一項由德國外交部補助1000萬歐元促成的特展——“啟蒙的藝術” 4月1號剛剛開幕。《德國之聲》7號報導說，不少德國政界人士要求"啟蒙的藝術"必要時應該撤展。

德國綠黨人權事務發言人貝克(Volker Beck)表示，中共對艾未未及眾多異議人士的強硬做法，違悖了「啟蒙運動」的理念。因為正是言論自由、新聞自由、藝術創作自由代表了「啟蒙運動」的精神，而這些理念應該是這次展覽所應該展現的。

Ai Detained for Economic Crime?

On April 6, after missing for 3 days, Xinhua,

mouthpiece of the Chinese Communist Party (CCP)

reported , “Ai Weiwei is being investigated

for economic crime.” An Global Times editorial,

also a CCP media, said that Ai Weiwei should pay

for persistently testing the legal base line.

Ai』s family has not been notified since his April 3

disappearance. On April 7, Xinhua Net reported

in English that Ai Weiwei was being investigated

for an economic crime.

This news was removed soon after.

But Wen Hui Po in Hong Kong reprinted the news.

One day before that, Global Times』 editorial

called Ai a 『rebel』, often taking actions others fear

and attracting many people just like him.

They claimed Ai should pay for his choice

of challenging the legal base line in China.

Chief Editor of Chinese Lawyer』s

Observation Network, Zhao Guojun, criticized

Xinhua, Renming Daily, Global Times

and other Chinese media for obstructing justice,

and promoting convictions without a legal trial.

Zhao Guojun: "With all the cases, whether it is law

of capitalism or socialism, American or Chinese,

we observe one rule: innocent until proven guilty.

No one should make wild judgment before a trial.

So you see, Global Times published an editorial

that in itself is an absurd."

Zhao Guojun: "If Ai Weiwei is a suspect

for economic crime, it should be fine if handled

according to the law. But we question

the legality of Ai Weiwei』s arrest."

Zhao Guojun: “Whether a citizen is a rebel

or not, he can be a suspect for a certain crime.

But before the allegation, legal institutions

and governments must act according to the law.

That is the key. Under the law, there is no concept

of 『being taken away』 or 』missing』 ”.

Patric Poon, Executive Secretary of CHRLCG

(China Human Rights Lawyers Concern Group),

told Voice of Germany: "The international society

will not accept how the Chinese regime handled it."

Patric Poon, "Suddenly, authorities』 media called

Ai Weiwei a criminal, with no family notification,

no explanation. How could lawful state act like this?

This is against the law of China itself."

After Ai Weiwei was arrested,

the German Government started to protest.

On April 1, in Beijing』s National Museum of China

was opened the exhibit 『Art of Enlightenment』.

This exhibit is funded by German』s Foreign Office

which paid 10 million Euros for it. On April 7,

Voice of Germany said many German politicians

requested the exhibition to be cancelled accordingly.

Volker Beck, Spokesman of German's Green Party

Human Rights said, "The hard line approach

toward dissidents violates the concept

of enlightenment. However, freedom of speech,

freedom of press, freedom of creation of arts,

are all representative of the spirit of enlightenment."
