【禁聞】中國的法律體系 能保障人民自由﹖

【新唐人2011年10月29日訊】近來中國大陸民怨沸騰,盲人維權人士陳光誠夫婦被當局暴力毆打消息流出;武警部隊針對訪民的演練視頻也被曝光,中國人權遭到中共國家機器的踐踏、法律被用作權力的工具。正當此時,中共國務院新聞辦公室發表《中國特色社會主義法律體系》白皮書,白皮書聲稱中國的法律制度能夠最好的保障中國公民的權利。下面請看中國律師的看法:

白皮書指出,中國依法保障公民的生存權和發展權,公民的人身權、財產權和宗教信仰自由、言論出版自由、集會結社自由、遊行示威自由以及社會保障權、受教育權等經濟、政治、社會、文化權利得到切實維護。

中國維權律師唐荊陵:「這個就是很清楚的,在中國這些基本自由,可以講都沒有得到保障,當然像這個國經辦他自己做為說謊機構,一個職業說謊的機構,他們歷來是在這方面說謊的,他們也不是第一次這樣做了,發佈類似這種的謊言,他也不是第一次了。」

中國近來社會事件頻發,山東維權人士陳光誠被非法軟禁甚至暴力毆打,廣東兩歲小女孩被車子碾過後,得不到路人的救助,公民的生存權和發展權不被保障;而北京當局強力鎮壓、騷擾和拘禁參與「茉莉花革命」人士,人民沒有集會結社和遊行示威的自由;另外,廣電總局大幅度限制衛星頻道的娛樂節目播出量,言論出版自由遭限制;上海討房團的維權活動仍在繼續,人民財產權被政府搶奪。

中國維權律師唐荊陵:「有大量的法輪功或者其他宗教信仰者被關押的事實,這是一直存在的,而且像最近的話,基督教的家庭教會也受到很殘酷的打壓,這個事情也都在國內已經傳的很廣了,不要說是在國際社會了,他這個﹙白皮書﹚完全是說謊的。」

唐荊陵說,中共所謂宗教自由是指:他們所控制的教會才可以公開舉行宗教儀式。

中國維權律師唐荊陵:「但是顯然就是說,不是這樣子,首先你如果不接受共產黨的話,不接受無神論的信仰,你就不可能有宗教信仰,因為在我們這裡,他憲法裡面規定無神論的信仰,是高過一切宗教信仰的,有這樣一個基本內容在的話,你要講有宗教信仰自由那是不可能的。」

白皮書還指出,反對西方的政治和法律概念,不會採用西方三權分立的做法。

對此唐荊陵表示,中共既然有所謂的完善社會主義法律體系,為什麼有那麼多的官員,他們的子女都加入了西方國家的國籍,他們的財產也都放在西方國家。

中國維權律師唐荊陵:「所以他們都已經用他們的錢用他們的子女都做出投票了,用他們自己的腳都做出投票了,就像以前耶穌基督曾經說過,你的財寶在哪裡你的心就在哪裡,他們的子女他們的財寶都在美國、在歐洲,不是在他們所主張的朝鮮那裡,他怎麼能說他們的心在中國呢,怎麼能說這個法律制度很好呢,能提供保障呢,他們為什麼不待在一個他們自己認為能夠給他們提供保障的地方,就要去一個他們絕對反對的地方呢,所以這個是很荒謬的,這樣的笑話我想是沒有人能夠相信的。」

Can CCP's Legal System Protect People?

Recently, in China, discontentment among people is high.

The exposure of the authorities’ assault and battery on

blind activist Chen Guangcheng and wife, as well as the

exposure of the armed forces’ training videos targeting

petitioners are just a few reasons why.

China's human rights have been trampled on by Chinese state apparatus.

China’s law has been used as a tool of power.

Meanwhile, the CCP’s State Council Information Office issued

the White Paper "The Socialist System of Laws with Chinese Characteristics." The paper claimed that China's legal system can best protect

the rights of Chinese citizens.

Chinese lawyers have different views.

The White Paper claims according to the laws, Beijing protects

the rights of the citizens, including Subsistence Right,

Development Right, Personal Right, Property Right, Freedom of Religion, Freedom of Speech, Freedom of Assembly and Association,

Freedom of Demonstration, Social Security Right, and Education Right.

Thus, the citizens’ economic, political, social, and cultural

rights have been effectively maintained.

Chinese human rights lawyer Tang Jingling said, "It is

very clear that in China these basic rights are not protected.

Of course, as the state agency itself is a professional liars’

organization, they have grown accustomed to lying in many aspects.

It’s not their first time to issue this kind of lie"

Recently, China's social incidents are frequent.

Shandong human rights activist Chen Guangcheng was

beaten violently and placed under house arrest.

A little girl from Guangdong was run over by two cars and

eighteen people turned a blind eye.

Chinese citizens’ Subsistence and Development Right has

not been protected.

Beijing authorities strongly repressed, harassed and detained the

people who took part in the "Jasmine Revolution,” showing that

people don’t have Freedom of Assembly and Association and

Freedom of Demonstration.

Moreover, the SARFT(State Administration of Radio Film and

Television) drastically limits the amount of entertainment

programs broadcasted by satellite channels.

Freedom of Speech has been restricted.

Shanghai’s activists for protecting housing rights continue to

fight as people’s Property Rights are snatched by the government.

Chinese human rights lawyer Tang Jingling said, "In fact, a

large number of Falun Gong practitioners and other religious

believers are imprisoned.

Those things have happened.

Recently, the Christian house churches have also been

suppressed brutally.

Those things are widespread in China, not to mention in the international communities.

The CCP’s White Paper is totally a lie.”

Tang Jingling said that the CCP’s so-called Freedom of Religion means: under CCP’s controls, the churches can hold ceremonies in public.

Chinese human rights lawyer Tang Jingling said, "But obviously,

it’s not like that.

First of all, if you do not accept the CCP and do not accept

atheism, you can not believe in other religions.

Because here in China the constitution orders that atheism is

higher than any other religion, it’s impossible to talk about

Freedom of Religion based on this.”

The White Paper also points out the anti-Western political and

legal concepts and that it is against Western ways of

separationof the executive, legislative and judicial powers.

For this, Tang Jingling questioned why, when the CCP has the so-called

perfect socialism law system, do so many officials and their

children join Western countries’ nationalities and send their

property to those countries.

Chinese human rights lawyer Tang Jingling stated,

"So they have used their money, their children, and their own

feet to make a vote.

Just as Jesus once said, ‘where your treasure is where your heart belongs.’ Their children and treasure are in the US and Europe, but not in North Korea, where they stand for (the government there).

Why don’t they stay in the place where they say they could get

protection; instead, they go the places where they are absolutely

against?

Thus it’s really ridiculous.

I think no one would believe this kind of joke.”

The multiple contradictions in Chinese society have long been prominent.

Facing the complex social conflicts, how can one-party

dictatorship CCP use law to solve these problems?
