【禁聞】中共「法制宣傳日」有宣傳沒法治

【新唐人2011年12月5日訊】12月4號是中國大陸的「法制宣傳日」,天津數百名維權人士申請遊行不獲批准,代表人還遭監禁。上海訪民則投書揭露一名雙腿殘廢的維權人士遭毒打。今年已經是中共宣揚「法制日」的第十五個年頭,然而大陸的法治何在?人民的保障何在?我們一起來關心。

天津市張建中、傅玉林、高香洪代表天津175位訪民,向天津市公安局治安總隊申請法制日示威遊行活動,經過代表們的連日努力,11月29號得到公安機關的正式受理。據了解,這是天津市破天荒的首次受理民眾的示威遊行申請。

張建中向媒體表示,他們在申請書中闡明:遊行示威能促使政府及各職能部門依法行政,懲辦貪腐行為,儘早解決拖延已久的冤假錯案,以推動民主法制進程。

然而,中國問題專家文昭說, 「在權力交接的前夕,共產黨的當權者都會有些『開明秀』,以博取國內外輿論的好感」。天津市受理遊行申請,被認為是天津市委書記張高麗爲了進「18大」政治局常委的政治秀。

果然,12月1號,天津市公安局治安總局管理總隊向張建中等人下達《集會遊行示威不許可決定書》,理由是:「如予許可將會引發不安定因素的連鎖反應,將會直接危害公共安全或嚴重破壞社會秩序。」

張建中向《自由亞洲電臺》指出,遊行不會造成社會不安定,真正的國家問題是中共的貪官污吏。麼

張建中:「(如果)我們遊行會產生社會的不安定因素、造成公共秩序的混亂,那麼貪官污吏把民眾迫害成這樣,他們就不會危害社會公共秩序了嗎?這些年之所以造成這樣的局面,要逼迫人民上街遊行,都是這些貪腐勢力造成的,他們才是罪魁禍首。」

另一方面,大紀元時報12月3號刊登一則上海訪民的投書,一名雙腿殘廢的維權人士劉柄同,由於參與艾未未債主活動,並且到山東臨沂探望陳光誠,12月2號下午,他在北京南站被五、六個人以鋼棍毆打。有人報110,電話裡警察說:這人被打是有原因的,還要報案人離開現場。而路人說,有警車經過也不阻止。

投書的作者質問:「法制日到了,中國的法制到底在哪裏?」

中華人民共和國憲法第三十五條聲稱,「公民有言論、出版、集會、結社、遊行、示威的自由」。

據了解,中國大陸民眾申請遊行示威,包括奧運期間,從來沒有被批准過。

投書作者認爲:「這一切不幸的根源都來源於權大於法,不是以法治理,而是人治,極少數人為了他們擁有的權力與金錢統治十多億人民,暴力壓制扭曲了人的心靈,人人自危冷漠的行為,這就是沒有法律保障的悲哀。」

12月3號,《權利運動》網站發佈消息說:「今天中午,天津維權人士張建中(網名反腐義勇軍)下樓外出時,被河北區牆子派出所2名警察限制外出。」據《權利運動》估計,「牆子派出所這次監禁張建中,與前幾天依法申請“12.4法制日”的遊行有關,而且有可能他將會被長時間限制外出。」

CCP "Legal Publicity Day" Does Not Follow the Law

On December 4th, the Chinese mainland's "Legal Publicity Day,

" a demonstration involving hundreds of activists in Tianjin,

was not approved, and yet, a petition letter in Shanghai

revealed a crippled activist suffered a violent beating.

This year marked the 15th annual Legal Day promoted by

the Communist Chinese.

However, where is the law? What protection do people have?

Let』s take a look.

On behalf of 175 Tianjin petitioners, Zhang Jianzhong,

Fu Yulin, and Gao Xiang Hong applied

for a demonstration permit on the Legal Publicity Day at the

Tianjin Public Security Corps.

With days of effort, the application was officially accepted

on November 29th.

This is Tianjin』s first public demonstration application.

Zhang Jianzhong told the media that the application explicitly

describes that “the demonstration is to promote the government

and the departments to function according to law by

punishing acts of corruption, resolving the long-delayed miscarriages of justice,

so that the democratic and legal process can be pushed

forward.”

However, Chinese affairs expert Wen Zhao said, “On the eve

of the handover of power,

the Communist Party often plays an “open-minded show”

to gain the goodwill of public opinion at home and abroad.”

Tianjin』s acceptance of the permit application is believed

a political show played by Tianjin Party Secretary Zhang Gaoli

as an entrance into Political Bureau Standing Committee

during the 18th National Congress of the CPC.

Sure enough, on December 1st, Tianjin Public Security issued

the “Permit Denied” to applicants Zhang Jianzhong on the grounds that

“A permit would trigger a chain reaction of unstable factors,

directly endanger public safety or seriously damage the social order.”

Zhang Jianzhong said to Radio Free Asia that the demonstration will not cause social instability;

The CCP's corrupt officials are the real problem

in this country.

Zhang Jianzhong: "(If) our demonstration would create unrest in the society,

and result in chaos to the public order, wouldn』t the

corrupt officials who have been persecuting the public cause damage to the social order?

The situation these years forcing people to rally are all

caused by these corruption forces. They are the culprit.”

Meanwhile, on December 3rd, the Epoch Times published a

petition letter from Shanghai stating a rights activist Liu Bintun,

whose both legs are disabled, was beaten by 5 or 6 people

with a steel rod in the afternoon of the 2nd at the Beijing South Railway Station.

When someone called the police, the police answered,

“This man was beaten for a reason.”

The informant was also instructed to leave the scene.

Some passers-by also said a police car that went by

would not interrupt either.

The writer asks: “It』s Legal Day,

but where the law in China?”

Article 35 of PRC Constitution claimed that "citizens enjoy

freedom of speech, press, assembly, association, of procession and of demonstration."

It is understood that applications for public demonstrations

in China, including during the Olympic Games, have never been approved.

The letter states: "The roots of all the misfortunes originate

from the power which lies above the law, governance not by law but man.

Very few people rule over a billion people for power and

money; the violence suppresses and distorts people's mind;

everyone feels insecure and behaves with indifference;

these are the sadness when there』s no legal protection."

The December 3rd 『rights movement』 website stated: "This

noon, as Tianjin activist Zhang Jianzhong went down the stairs to go outside,

two police from Hebei District police station restricted

his move."

The 『rights movement』 stated, "Zhang Jianzhong』s movement

was limited because of his application for the Legal Day demonstration a few days ago.

It is also likely that his movement will be restricted for

a long time."
