【禁聞】我的護照為甚麼中共做主?

【新唐人2011年4月9日訊】大陸當局利用護照和簽證,控制並迫害民眾的事情,近來引起全世界的關注。中共官方都採用甚麼手段去做的?他們這樣做合乎國際公約和大陸相關的法律嗎?中國人應該如何破除這種限制?請看詳細報導。

大陸當局限制民眾出國,近來引起國際關注。先是3月底,中國作家廖亦武被禁止出國,然後是4月3號,大陸知名藝術家艾未未被首都機場的警員攔下,之後,艾未未音信全無,多國政要要求中共當局放人。

據了解,中共限制國民出入境的一系列措施,是在上世紀80年代以後逐漸成型的。其中也包括禁止某些持有合法護照的海外中國人回國,這些中國人在申請中國護照延期,或更換護照時,海外的中使館、領館就扣留他們的護照。

從99年中共鎮壓法輪功以來,海外就有上百名法輪功學員被當地使、領館剝奪了海外的合法身份證明——護照,給他們在找工作、租房子等正常生活,帶來很大的不便。而上海的維權人士馮正虎,在日本成田機場堅持了90多天的回國權,更是轟動了全世界。

加拿大女作家盛雪,在1996年持加拿大護照和中國的合法簽證,想回國和母親共度中秋節,卻被大陸國安攔截在機場裡,經歷了24小時的輪番審訊,最後被驅逐出境。

加拿大作家盛雪:“實際上,利用人的親情、友情、鄉土情、思念親人的這種人類最基本的這樣一種倫理情感,來脅迫人,然後迫使人去放棄自己的信念,迫使人向一種權利不得不做出讓步,這可以說是最最最邪惡的一種做法。”

除了禁止國人正常出入境外,中共也在簽證上控制西方人入境。《自由亞洲》、《美國之音》的多位華人和西方記者,經常無法得到中共的簽證,因而無法報導中國正在發生的新聞事件,尤其是第一現場的報導。

德國著名的漢學家馬漢茂教授,在1989年到1999年期間,也被大陸當局嚴格的排斥在入境外,因為他看到89年六四屠殺後公開站出來,堅決反對中共集權,10年中,他在自己的良知和事業無望的痛苦中煎熬。最後在1999年,當他主持完「六四」10週年的公祭後,馬漢茂翻身跳下樓去,用生命來抗議這種不公。

按照普世的認識,一個人出生後,他的國籍和出生時間、性別一樣,是與生俱來的。在國際法公約中,《世界人權宣言》明確“人人有權享有國籍”,“任何人的國籍不得任意剝奪。”即便在中共自己的《護照法》裡,也堂而皇之的在第二條寫道:“任何組織或者個人不得偽造、變造、轉讓、故意損毀或者非法扣押護照。”而“非法護照由公安機關收繳”,因此,按照大陸自己的法律,海外的使、領館只有為海外華人服務的權利,也就是説,只辦理延期和更換護照。

中國政法大學的著名憲法學者陳小平,曾在美國中領館申請延期護照時被拒絕,隨後他向人大和人大常委會提起憲法起訴。

時事評論員橫河:“他(陳小平)就提出來:在中國的國籍法裡面國籍是不可被剝奪的,而護照是國籍的證明。他提到,雖然中國的出入境管理條例裡面有吊銷和護照作廢的規定,但是那必須是原發證機關或者上級機關做出來,而總領館是沒有這個資格的。”

一位目前隱身在北美的中共原公安部高官表示,中共千方百計的控制人員出去,是怕自己的醜行曝光﹔另一方面,又控制境外的所謂的敵對勢力進去。

中共前駐悉尼總領事館外交官陳用林:“它(中共)主要就是為它的政權考慮,是不是對它的政權有利,就是它認為有可能會影響到它政治穩定,它寧可冤枉一萬,也不要放過一個。就是…這個政權它首先考慮的就是利益集團、政權本身的穩定,和個人的私利。”

《大紀元時報》編輯部也發出特稿指出,擁有個人護照是一個公民最基本的權利,而中共卻利用它來向世界炫耀說:“到哪兒都逃不出我的手心”,中共的這種作法是流氓控制的暴力手段。

加拿大作家盛雪:“在這個過程當中,最大的悲劇就是許多人在內心逐漸形成一種恐懼,喔!我這樣說的時候會不會惹得這個共產黨對我進行報復,那麼很多人形成這麼一個思維慣性,(中國)人確實成為一個不能獨立思想、沒有基本道德規範的一群生物。”

旅德極權主義問題專家仲維光在1997年,也被中共海外領館剝奪護照,使他在母親重病臥床的3年期間,無法回國盡孝,更沒能讓母親臨終前看到他最後一眼。作為研究極權主義問題的學者,他非常清楚製造恐怖和謊言,是極權社會的兩個最重要的特點,所以,他認定,要想擺脫專制就得勇敢而智慧的去衝破限制。

旅德極權主義問題專家仲維光:“不去配合它(中共),採取必要的策略、必要的措施,不買它的帳!你去接受一個傳單、去傳播一個真相、去聽一場非黨文化的音樂,去唱一首非黨文化的歌,都是對抗它的方法。”

北美一位資深的人權活動家向《新唐人》表示,聯合國沒有針對一國政權剝奪公民護照、造成國籍難民這方面問題的特派專員,因為中共的做法在全世界是獨一的。他表示,世界上其他國家和聯合國可能想都沒想到,還能有這樣無恥的迫害民眾的行為。

Why Does Chinese Regime Control My Passport?

Mainland authorities use passports and visas to control

and persecute people, causing worldwide concern.

What means do Chinese officials take? Do they act

Mainland authorities restrict people to go abroad

Causing international attention. First, Chinese writer

Liao Yiwu was prohibited to go abroad, at the end of

March, later well-known artist Ai Weiwei was stopped

at the airport on April 4. No one knows his whereabouts

since. Leaders from many countries requested

for his release.

It is understood, after 1980, Chinese authorities slowly

shaped up measures to restrict people for immigration,

including prohibition of certain passport holders

to return. Overseas embassies or consulates withheld

their passports when they applied for passport

extension or passport replacement.

Since the persecution of Falun Gong in 1999, Chinese

embassies or consulates withheld hundreds of legal

identification of Falun Gong practitioners and caused

tremendous inconvenience in finding a job or renting

an apartment. Rights activist Feng Zhenghu stayed in

a Japan airport for over 9o days for his right to return

to China and shocked the entire world.

In 1996, Canadian writer Sheng Xue had a legitimate

Canadian passport and Chinese visa, hoping to go back

and spend Mid-Autumn Festival with her mother.

She was intercepted at the airport by State Police.

After a 24-hour interrogation, she was deported.

Sheng Xue (Canadian writer):

“In actuality, to exploit human affection, friendship,

love of hometown and love ones to intimidate people

and force people to give up their conviction or make

a concession to a certain power. It』s the most evil of all.

In addition to the normal immigration ban, authorities

also control the entry visa of Westerners.

Many Chinese and western reporters from “Free Asia”

and “Voice of America” often fail to get a visa and

therefore cannot report events taking place in China,

especially the first report of an event.

A famous German Sinologist professor Ma Hanmao,

was strictly excluded from entry during 1989-1999.

Because he openly and firmly opposed communist

totalitarianism after watching the 1989 massacre.

He suffered pain from his own conscience and failed

career for 10 years. In 1999, after finishing “June 4”

ceremony for the 10th anniversary, he jumped off

a building and protested against that kind of injustice.

Based on the universal understanding, nationality and

time of birth, sex, come with the birth of a person.

"The Universal Declaration of Human Rights" of

the international law, declares “Everyone has the right

to a nationality". Even in China』s "Passport Act",

in the second act: "Any organization or individual may

not counterfeit, alter, transfer, intentionally damaged

or illegally seized passport, but public security bureau

can confiscate illegal passports. According to the law

in mainland, embassies and consulates overseas have

only an obligation to provide services, namely, process

applications for passport extension or replacement.

Chen Xiaoping, a leading constitution scholar from

China University brought charges against the Chinese

Consulate in the U.S. and then the NPC and the

Standing Committee after his application for passport

extension was denied.

Yokogawa (political commentator):

“He pointed out that nationality cannot be deprived in

nationality law in China, and passport is a proof of

nationality. He said that although there are invalid

passports revoked, the provision of it must be

the original issuing authority or a higher authority

to do it, the Consulate General is not qualified.

Hiding in U.S. a former official of public security said

,the mainland authorities are trying to prevent people

from going abroad for fearing of exposure of their bad

deeds; meanwhile disallow the oppose force to come in.

ChenYonglin (ex diplomat at the PRC Consulate

General in Sydney):

"The Chinese Communist Party(CCP) thinks mainly

for its own political power. Is this good for the Party?

if it may affect its political stability, it would rather

kill ten thousand wrongly but not miss one.

The regime's first consideration is interest groups,

the stability of the regime itself, and personal interest. "

A special editorial from The Epoch Times also pointed

out: A personal passport is the most basic rights of

a citizen, and the Chinese authorities use it to boast

to the world that one cannot escape from its clutches.

This kind of practice by the Chinese Communist Party

is a gangster –controlled violence.

Sheng Xue (Canadian writer):

"During this process, the greatest tragedy is that many

people gradually become fearful in their hearts.

Oh! when I say that,the CCP will retaliate against me.

Therefore, many people formed such a belief that

Chinese cannot think independently, they are nothing

but a bunch of organisms with no basic moral standards.

In 1997, the Chinese overseas consulate withheld

Zhong Weiguang's passport. Zhong is an expert in

totalitarian but lived in Germany. His mother was

seriously ill. And he was prevented from seeing his

mother before her death. Being a totalitarianism

scholar, he knows well creating terror and lying

are two main traits of totalitarian society. He thinks

courage and wisdom are needed to be free of tyranny.

Zhong Weiguang (totalitarian expert touring in Germany):

“Don』t cooperate with CCP, use necessary strategies

and necessary measures, do not play along. Taking a

flyer, clarifying one truth, or listening a non-Party

culture concert and singing a non-Party song are all

methods against the Party.

A veteran human rights activist in North America

told "New Tang Dynasty" that the United Nations

do not have special agents to deal with citizens

being deprived of passports and turning into refuges

of the world. Because the action taken by the CCP

is the one and only in the entire world. Such a

shameless persecution of its own citizens is far

beyond any country's imagination.
