【禁聞】深圳驅逐八萬人 律師:不合法

【新唐人2011年4月13日訊】第廿六屆世界大學生夏季運動會,將於8月在深圳舉行。為此,深圳警方召開新聞發佈會,表示在過去的100天裡,已令八萬多名所謂「治安高危人員」離開深圳,今後會更加嚴打犯罪份子,並招募五十萬名市民,就地監察。中國維權律師李和平表示,這項做法「違法」。

為準備第廿六屆「世動會」8月在深圳舉行,當地警方由元旦起實行「治安高危人員排查清理百日行動」,這期間,當局拘捕了8千多人,並驅逐超過八萬名的所謂「治安高危人員」出深圳。

深圳市公安局副局長兼新聞發言人解釋,所謂「治安高危人員」,是指沒有正當理由而長期滯留深圳,行蹤可疑,對深圳治安和市民生命財產安全,構成現實威脅的人員。他還表示,這項行動不會停止,還將召募五十萬名市民當「紅袖章」人士,監察家居或範圍內的人,並在各小區加設閉路電視,監察人員進出。

中國知名維權律師李和平表示,警方憑著自己的「主觀印象」區分人群,這本身就不合法。

李和平(維權律師):「第一,中華人民共和國憲法規定,法律面前人人平等。每 一個人的合法權利都要受到法律的保護。那麼深圳將八萬人,他們認為的所謂的特殊人群,就要進行驅趕,那麼顯然是違背了這條。第二個,行政法有個原理就是說法律授權你才能做,法律沒有授權,行政機關工作人員做了,那都是違法甚至是犯罪,這顯然是違法的。違反行政法的一個基本的原理。」

深圳居民孫先生向《新唐人》表示,這種做法讓老百姓人心惶惶。

孫先生(深圳居民):「這樣就害苦了很多的老百姓,很多的平民百姓就遭殃了。有很多老百姓想到這裏來找份工作啊,想到這裏找點小生意做啊,也是想到這裏來安下來過點小日子啊,但是他就把這麼一些人全都弄得人心惶惶的。」

河北《燕趙晚報》批評說,警方目前的做法只會讓這些人生活無著落,增加社會的不穩定因素。而一刀切的把所謂的「治安高危人員」清理出自己所轄的城市,顯然是一種懶政。

張先生(深圳居民):「我們這個執政黨,現在就是由於那個埃及的暴動以及一些國家推翻獨裁政權,那我們中國的執政的主體有一定的困難度,現在我們中國共產黨已經領導了我們62年 了,但現在為止,他們也很恐慌。埃及事件啊,一個是貪污,第二個就是就業,再一個就是物價高起。我們中國也存在埃及的問題。我們中國現在也存在貪污。第二,失業,還有物價高起等。」

《國際在線》有文章指出,其實,一個大型賽事活動的安保,就是檢驗一個國家的文明程度,我們不能因為安保任務重,就採取一刀切的方式來剝奪公民的合法權利,這違背了大型國際賽事舉辦的初衷。這與「大運會」核心價值不符。

而深圳獨立學者朱建國告訴《自由亞洲電臺》,深圳警方在 「治安高危人員」 七類人中,特別提到了「有報復社會的極端言行,可能危及他人或公共安全的」人員,他說,「這個模糊的界定很可能成為有關當局打擊民間聲音的藉口。」

The 26th Summer World University Games will be

Public Security Bureau explained the so-called

"High-Risk Security Personnel" refers to those

who lived long in Shenzhen without justification,

He also expressed this operation will continue.

They will recruit 500,000 people as "red armbands"

to monitor people at home and those within the

profile in particular, and will install cameras

in each neighborhood to monitor people in and out.

China's renowned human rights lawyer Li Heping

said it is illegal for the police to single out people

based on their own "subjective judgment"

Li Heping: “First, the Chinese Constitution states

equality is before the law. The legal rights

of each individual are protected. It is against the law

to expel 80,000 people whom the police singles out.

Second, the principle of administration is based on

authorization by law. If the law does not authorize

the administrative staff to carry out an operation,

it is illegal or even criminal to carry it out.

It is a violation of the fundamental principle

of the administrative law.”

Shenzhen resident Mr. Sun told NTD Television

that this operation makes people panic.

Mr. Sun: “It hurts a lot of people. Many people came

to Shenzen to look for a job or to do small business.

They want to settle down to start a life.

What the police is doing makes people panic.”

Hebei Province's Yanzhao Evening News criticized

the current practice as taking away people's income

and increasing social instability. To clean up

the so-called "high-risk people" out of the city

under their jurisdiction is an obvious lazy practice.

Shenzhen resident Mr. Zhang: “Due to Egypt's riots

and the overthrow of some totalitarian regimes,

the Chinese government has some difficulties.

The Chinese Communist Party (CCP) ruled China

for 62 years and is panicking now.

The reasons for Egyptian revolution are corruption,

unemployment and sharp price increases.

An article from International Online points out,

that the security work for a large sports event

is a test to a country's level of civilization. “We can't

deprive citizens of their rights to heavy

security protection. This is against the purpose

Shenzhen independent scholar Zhu Jianguo told

Radio Free Asia, that the 7 categories

of "High-Risk Security Personnel", particularly

Zhu Jianguo: "Such vague definition is likely

to be the authorities' excuse to suppress people."
