【禁聞】法學教授抨重慶“打黑”猶如文革

【新唐人2011年4月15日訊】中國法律學者賀衛方發表公開信，尖銳指出，在四川重慶的“打黑”行動中，行政權力干預司法等違法現象，讓人有時光倒流、文革重演的感受。請看下面報導。

北京大學法學院教授賀衛方，在「致重慶法律界的一封公開信」中，直言不諱的指出，重慶已經持續兩年多的“打黑除惡”運動，令人有時光倒流、文革重演之感，法治的理想正在淪喪。

賀衛方以北京律師李莊案件為例，說明重慶法庭在司法原則中的「基本中立性」已經蕩然無存。

讓律師界一年多來牽掛的“李莊案”，重慶市江北區檢察院在4月2號提出新的指控，再次追訴原北京律師李莊。

2009年12月10號，重慶市公安局以李莊在代理重慶龔剛模涉黑案中，以「涉嫌偽證罪」的理由，對他立案偵查。2010年2月9號，重慶市一中院判處李莊有期徒刑一年零六個月。

據李莊案代理律師陳有西表示，二審開庭結束後，他去會見李莊時，李莊親口告訴他，重慶打黑專案組和檢察院要他認罪，只要他認罪，保證不再公開開庭，以書面審理，並且保證判他緩刑，放他出獄。

結果，重慶專案組在拿到李莊的《認罪書》後，仍決定開大庭審判李莊。對於代理律師陳有西“揭秘”的內容，重慶官方至今沒有給予回應。

賀衛方在公開信中提醒，政府“以黑制黑”，用非法手段打擊犯罪，可能造成日後更加可怕的反社會力量。他還以重慶市「原司法局局長文強的前車之鑒」警告中共，沒有獨立的司法，就沒有人是安全的，手握大權者也不例外。

就在賀衛方教授和法律界人士呼籲法律公正的同時，中央政法委副秘書長陳冀平卻向媒體表示，“中國是治安最好的國家之一”。

北京律師劉曉原：“說社會治安很好，這是高壓的管理手段所造成的一種假象。外表看來似乎很好，潛在的危機沒有暴露出來。”

旅美權益人士劉念春表示，中國的治安，將人權擱在一邊，是統治階級意志的體現。

劉念春：你說你是世界上社會治安最好的國家，你還得讓人民公認。像錢雲會那個事件，這樣的惡性事件都在國內可以發生。那你怎麼能說你治安好？而且你這種治安它不是按照法律程序走的，它是按照統治階級的意志做的。你採取的是一種暴力手段來維持你社會治安的局面。”

劉念春認為，對中共當局來說，一切都是為著「維穩」。他舉例說，當局抓藝術家艾未未，事先並沒有出示抓艾未未的理由？到底艾未未觸犯哪條法律？抓完之後也沒有通知家屬，就說明「維穩」是對自由表達的壓制。

China One of Best for Law and Order?

During Chongqing』s anti-crime movement,

He Weifang, a Chinese legal scholar, wrote

an open letter, sharply pointing out, how

the executive branch violated the judicial branch

like in the Cultural Revolution.

He Weifang, law professor of Peking University,

bluntly pointed out that Chongqing』s

anti-crime campaign has lasted 2 years

but felt like Cultural Revolution again,

indicating the decay of the ideal of rule of law.

He Weifang singled out Beijing lawyer Li Zhuang,

illustrating how "basic neutrality " in the principles

of justice in Chongqing court is completely gone.

The court in Chongqing brought new allegations

against Li on April 2, causing great concern

to the legal profession for more than a year.

Chongqing Public Security Bureau investigated Li

on December 10, 2009 for suspected perjury

when Li represented Gang Gong in a criminal case.

After that Li was sentenced to 18 months in prison.

According to Li』s attorney Chen Youqi, Li told him

that after the second trial hearing, Chongqing』s

Special Anti-Crime Group and the Procuratorate

wanted him to plead guilty for no open trial

and guarantied probation instead of a jail sentence.

Li pleaded guilty but the Special Anti-Crime Group

still decided to an open trial. Officials remain silent

to inquiries of Li』s plea bargain.

He Weifang reminded the government that using

Illegal means to fight crimes may result in

worse anti-social forces. He singled out former

Justice Secretary Wen Qiang to warn authorities:

without an independent judicial branch,

no one will be safe, not even those in power.

While He Weifang appealed for justice, deputy

secretary general of the Central Political and Law

Commission Chen Yiping told media that

China is one of the best countries for law and order.

Beijing lawyer Liu Xiaoyuan: "This good

『social order』 is an illusion coming from high-pressure management measures.

It looks good and shows no potential crisis."

America-based rights activist Liu Nianchun thinks that human rights aside, China's law and order is only a manifestation of the will of the ruling class.

Liu Nianchun: "You say you are the best country

in social order, but your people must confirm that.

How can you say you are the best in law and order

and yet allow Chian Yunhui incident to occur?

Your law and order comes from following

the will of the ruling class.

You are using violence to maintain law and order."

Liu Nianchun believes that the Chinese authorities

do everything to maintain stability. They have not said

why Ai Weiwei was arrested; they did not notify

his family. All that is called "stability maintenance"

but it is actually suppression of free expression.
