【禁聞】雲南驚現山寨版蘋果專賣店

【新唐人2011年7月23日訊】近日有網友在博客上踢爆:雲南有幾家山寨版的「蘋果電子產品」專賣店,引發國內外媒體關注。本臺記者致電數家經銷商,他們聲稱自己是蘋果公司產品專賣店。但是在蘋果公司官網上顯示,中國只有北京和上海兩地有專賣店。

根據博客BirdAbroad所傳出的照片顯示,這些假冒的「蘋果商店」,提供正宗「蘋果公司」專賣店中的所有東西。員工身穿的藍色T恤上印有「蘋果」商標,每位員工都有名牌。店內裝修也和正牌「蘋果」商店一樣寬敞、光亮奪目。最不可思議的是,這些假冒「蘋果」商店的員工都認為自己在為「蘋果公司」工作。

根據「新浪科技報導,假冒的「蘋果公司」商店按照產品區域不同,而鋪設木地板或灰石地板,陳列的產品從iPad到Mac電腦應有盡有,陳設產品的桌子也和官方「蘋果公司」商店的幾乎一模一樣。假冒的「蘋果」商店內,甚至還有正宗「蘋果」商店的旋轉扶梯、兒童遊戲區以及員工產品介紹區。或許是知道自己的行為不合法,這些假冒的商店內禁止拍照。

本臺記者通過搜搜網找到昆明幾家所謂的「蘋果公司」專賣店。其中兩家聲稱在官網上有他們的名字。但是「蘋果公司」官網顯示,只有北京和上海有專賣店。

協創豐澤園西電子廣場店:(請問您這裡是『蘋果』專賣店嗎)對啊。您是哪裏啊?(你們這裡是正宗的嗎)肯定是啊。(那你們有美國總部的授權嗎)有啊。但是我們不會出示給你看的。(為甚麼)那我們要這樣做生意多纍啊。來一個人出示一份,來一個人出示一下,沒這個必要的。蘋果官網上有我們店面的地址。

南方源園西電子廣場店:「(請問你們這裡是『蘋果』專賣店嗎)是『蘋果』專賣店。(請問你們這是正宗的嗎?)是啊,我們在『蘋果』(公司)官方網站上可以查得到的。(那你們有美國總部的授權嗎)我們沒有美國總部的授權。因為這個授權是中國給的。美國不給。美國的店才是是美國給。中國的店是中國給。」

北京律師謝燕益表示,仿冒「蘋果」專賣店肯定是侵權和違法行為。

謝燕益:「這種情況現在中國也比較普遍,不僅是『蘋果』,可能其他的假冒偽劣的,侵犯智慧財產權的一系列所謂『山寨現象』,還是一個很普遍的現象。他既然在昆明進行這麼一種『山寨的蘋果專賣店』。他也許當地有他的保護傘。因為他開這個店是有很大成本的,冒著很大的風險。」

北京律師楊慧文表示,國內各行各業的造假行為很普遍。他覺得更嚴重的是食品造假行為。

據《美國之音》報導,一位昆明市民透露,昆明現在有三、四家這樣的假冒專賣店,今年上半年開張,分別位於武成路、正義路和小西門等地。這位市民表示,這些店的規模都比較大,產品一應俱全,例如iPhone,一家店裡就有樣機十幾部。

「蘋果公司」首席運營官蒂姆?庫克說,中國市場是「蘋果公司」在上個季度盈利的主要驅動力。為了維持高端產品形象和業界獨特地位,「蘋果」在中國只開設四家專賣店,位於北京和上海兩地。目前,「蘋果公司」沒有對假冒專賣店作出評論,也沒有提出法律訴訟。

A Copycat Apple Store In Yunnan Province

Netizens recently revealed the existence of a copycat

Apple store in Yunnan Province—which has aroused

a lot of attention from domestic and foreign media.

When our reporters contacted these copycat outlets,

they all claimed to be authentic Apple Inc. stores,

even though Apple's official China website lists

just two locations, Beijing and Shanghai.

The photos uploaded by a bloger, BirdAbroad, showed that,

these fake Apple stores provide authentic Apple Inc. products

and all the salespersons are wearing badges

and blue T-shirts with Apple logos on them.

The stores are spacious and bright like authentic Apple stores.

Surprisingly, these salespersons in these fake stores believe that

they are actually working for Apple Inc.!

Sina Tech reported that these fake Apple stores have

wooden or gray stoned floors in different product areas.

Their products range from iPads to Mac computers, and even

their tables look like the ones used in official Apple stores.

These fake stores even have the same spiral stairs,

children's game areas,

and product introduction areas as

those in the real Apple stores.

Customers are told not to take pictures in the stores,

perhaps the owners know that these stores are illegal.

Our reporters found these so-called

Apple Exclusive Stores online via soso.com.

Two of them claim to be listed on Apple's official website, even

though the website only lists the Beijing and Shanghai locations.

A store in Xiechuangfengze West Digital Plaza:

(Is this an Apple Exclusive Store?) “Yes. Who is this?”

(Are you authentic?) “Of course.” (Do you have official

authorization from the U.S.?) “Yes, but we won't show you.”

(Why not?) “We'd be so tired if we showed every customer

our authorization. It's just not necessary.

You can find our address on Apple's official website.”

A store in South Source West Digital Plaza: (Is this an Apple

Exclusive Store?) “Yes, it is.” (Are you authentic?) “Yes, you

can check on Apple's official website.” (Do you have official

authorization from the U.S.?) “No, only from China.

Stores in the U.S. get authorization from the U.S. while stores

in China get authorization from China.”

A Beijing lawyer, Xie Yanyi, said that faking Apple Exclusive

Stores is illegal and an infringement of Apple's rights.

Xie Yanyi said: “Phenomena like this is very prevalent

in China, not only with regards to Apple Inc.,

but with other counterfeit commodities, too. This is

an infringement of Apple's intellectual property rights.

The fake Apple stores may have local officials protecting

them to exist, like in Kunming City, considering

the huge cost and risk involved in operating such stores.”

Beijing lawyer, Yang Huiwen, said that,

such counterfeit are very common in all fields in China,

with fake food being the most serious problem.

According to Voice of America, a local in Kunming City

revealed that there are now 3 to 4 fake Apple stores in that

area, which opened up in the first half of this year and are

located on Wucheng Rd., Zhengyi Rd., and Xiaoximen Rd.

This person said that each store is very large

and they sell every Apple product, including the iPhone.

A single store will have a dozen iPhones models on display.

Apple's chief operations officer, Timothy D. Cook,

said that the market in China was

a major driving force behind last season's profit.

To maintain an image as a high-end and specialty product,

Apple Inc. only opened a total of four stores in China,

Currently, Apple Inc. has not commented on the fake stores,

nor have they taken any legal action yet.
